1. Overview

Welcome to ChocTilly Ltd (“ChocTilly”, “we”, “us”, “our”), a company registered in England & Wales (Company No. 13123462), with its registered address at 68 St Mary’s Street, Bridgnorth, WV16 4DR, United Kingdom.

We design handcrafted chocolate collections and curated in-person workshop experiences. Through our website and online store (the “Services”), we offer our products and experiences for purchase. Our store is powered by Shopify, which enables us to provide the Services to you.

By accessing, browsing or purchasing from our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our Services.

2. Eligibility

You must be at least 18 years old to place an order with us. By purchasing from ChocTilly, you confirm that all information provided is accurate, complete and current.

We reserve the right to refuse service or cancel orders at our discretion, including where we suspect fraud, misuse, or breach of these Terms.

3. Our Products

3.1 Handcrafted Nature

All ChocTilly chocolates are handcrafted in small batches. As such, slight variations in appearance, finish, colour or decoration may occur and do not constitute defects.

Product imagery is representative and may vary depending on screen display settings.

3.2 Allergens & Ingredients

Our products are prepared in environments that handle allergens including (but not limited to) milk, nuts, peanuts, gluten, soy and sesame.

While we take great care to manage allergens, we cannot guarantee the complete absence of trace allergens. It is your responsibility to review product information and contact us prior to purchase if you have specific dietary requirements or allergies.

3.3 Storage & Care

Chocolate is sensitive to temperature and storage conditions. We are not responsible for deterioration, melting or damage caused by improper storage after delivery.

4. Workshop & Experience Bookings

Workshop and in-person experience bookings are subject to availability and are confirmed only upon receipt of payment.

Bookings are non-refundable but may be rescheduled with a minimum of 48 hours’ notice in accordance with our Refund Policy.

We reserve the right to:

  • Make reasonable changes to instructors, minor content, or materials
  • Reschedule events due to circumstances beyond our control
  • Cancel events where necessary for safety or operational reasons

If we cancel an experience, you will be offered an alternative date or a refund.

Participants must follow all safety guidance provided during workshops. We reserve the right to refuse participation where behaviour is unsafe or disruptive.

5. Orders & Acceptance

When you place an order, you are making an offer to purchase. A binding contract is formed only when we send you an order confirmation.

We reserve the right to decline or cancel any order, including in cases of:

  • Pricing errors
  • Product unavailability
  • Payment authorisation failure
  • Suspected fraudulent activity

If we cancel an order after payment has been processed, a full refund will be issued.

6. Pricing & VAT

All prices are listed in GBP (£) and include VAT where applicable unless otherwise stated.

Delivery charges are calculated separately at checkout.

We reserve the right to amend prices at any time. The applicable price is the one displayed at the time of checkout.

7. Delivery & Risk

Delivery times are estimates and are not guaranteed.

Risk in goods passes to you upon delivery to the address provided. You are responsible for ensuring accurate delivery details at checkout.

We are not liable for delays caused by courier services, customs processes, weather conditions, or other events beyond our reasonable control.

8. Cancellation Rights (Distance Selling)

Under the Consumer Contracts Regulations 2013, consumers generally have the right to cancel online purchases within 14 days.

However, this right does not apply to:

  • Perishable goods, including chocolate and food products
  • Goods made to your specifications or personalised items
  • Services relating to leisure activities (including workshops) provided on a specific date or period

Accordingly, most ChocTilly purchases are exempt from standard cancellation rights. Please refer to our Refund Policy for full details.

Your statutory rights under the Consumer Rights Act 2015 remain unaffected.

9. Intellectual Property

All content on this website — including branding, designs, product names, text, graphics, photographs and logos — is the intellectual property of ChocTilly Ltd and may not be reproduced, distributed, modified or used without our prior written consent.

10. Third-Party Services

Our website may contain links to third-party services or tools, including those provided by Shopify. We are not responsible for third-party content, policies or services.

All purchases are made directly with ChocTilly Ltd. Shopify is not responsible for transactions between you and ChocTilly.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any matter for which liability cannot be excluded under English law

Subject to the above, ChocTilly Ltd shall not be liable for any indirect, incidental or consequential losses arising from the use of our Services or products.

Our total liability shall not exceed the total amount paid by you for the relevant order.

12. Force Majeure

We shall not be liable for failure or delay in performing obligations where such delay results from events beyond our reasonable control, including but not limited to natural disasters, supply chain disruption, labour disputes, or government restrictions.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We reserve the right to update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of those changes.
